Tribunal de Justiça suspende decisão que determinava que o Município de Gararu só pagasse aos artistas e fornecedores após a adequação de Ginásio dê Esportes.
No recurso apresentado pelo Municio de Gararu o Desembargador Relator José Pereira Neto entendeu que o pedido do Ministério Público, neste momento, não se mostra razoável, pois há contrato assinado, bem como ordem de serviço, com dotação orçamentária especifica para a realização da reforma do Ginásio.
Dessa forma, restou comprovando que o Município tomou todas as medidas administrativas possíveis para as reformas do Ginásio de Esporte, como requerido pelo Ministério Público na Ação Civil Publica, devendo-se aguardar apenas a realização das obras que tem duração de 5 meses.
Ressaltou o Desembargador Relator que: (…) a realização da festa se mostra legal, diante, como antes citado, da decisão proferida em 19/12/2022, sem que fatos novos viessem à tona, desconstituindo o direito alcançado pelo agravante.”
