Três pessoas foram filmadas fazendo sexo no espigão da Praia de Iracema, em Fortaleza, na noite desta segunda-feira (6). O ato sexual é praticado por dois homens e uma mulher.
As cenas de sexo ganharam repercussão nas redes sociais. O flagra foi registrado por uma pessoa que passava pela orla marítima da cCital cearense. De acordo com o Código Penal Brasileiro, praticar sexo em público é crime. Ele se enquadra no Artigo 233 que se refere à prática de ato obsceno. A pena prevista para este tipo de crime varia de três meses a um ano de prisão ou multa. O crime é registrado como contravenção penal.
Em nota, a Secretaria de Segurança Pública e Defesa Social afirmou que a Polícia Civil investiga “as circunstâncias de um ato obsceno realizado por três pessoas em um trecho da Praia de Iracema”. A corporação ressaltou que a prática de ato obsceno em lugar público, aberto ou exposto ao público é crime previsto no artigo 233 do Código Penal, que “também estabelece que oferecer, trocar, disponibilizar, transmitir, vender ou expor à venda, distribuir, publicar ou divulgar esse tipo de conteúdo, sem o consentimento dos envolvidos, é crime, conforme o artigo 218”.
