Os vereadores de Canindé de São Francisco Caloi, André Agente de Saúde, Roque do Cuiabá e Jenilson da Saúde, todos do PT, foram cassados pelo Tribunal Superior Eleitoral (TSE) na sessão desta quinta-feira, 16. O pleno alegou a prática de fraude à cota de gênero e declarou nulos os votos recebidos pelas candidaturas do partido para o cargo de vereador nas Eleições 2020.
O Plenário também desconstituiu o Demonstrativo de Regularidade de Atos Partidários (DRAP) da legenda e os diplomas das candidatas e dos candidatos que concorreram às vagas pelo partido. A decisão, que deve ser cumprida imediatamente, abrange o recálculo dos quocientes eleitoral e partidário para a função de vereador do município sergipano.
Por unanimidade, os ministros acompanharam o voto do relator, ministro Sérgio Banhos, que deu provimento ao recurso especial eleitoral interposto por Gregório Leite Alves Júnior e outros quatro candidatos a vereador pelos partidos Partido Social Democrático (PSD) e Republicanos. Eles recorreram ao TSE para tentar reverter a decisão do Tribunal Regional Eleitoral de Sergipe (TRE-SE). Ao analisar Ação de Impugnação de Mandato Eletivo (Aime) ajuizada, a Corte Regional havia descartado a hipótese de violação à reserva mínima de 30% para candidaturas de cada gênero.
Segundo os recorrentes, o nomes de Tânia (PT) e Sônia (PT) teriam sido lançados pelo partido somente para legitimar a participação não praticou atos de campanha, e sequer foi registrado voto no número o qual concorreu na Seção Eletoral que a mesma votava.
Os recorrentes também alegaram que, além de não obter votação pífia (2 votos e 1 voto, respectivamente) e de não ter despesas relativas a material de campanha, como panfletos e adesivos, ela não teria realizado propaganda eleitoral pessoal nas redes sociais, tendo o seu cônjuge gravado vídeo realizando pedido de voto para outro candidato, por meio do principal meio de divulgação das candidaturas nas Eleições 2020, que ocorreram durante a pandemia de covid-19.
Voto do Relator
Para o ministro Sérgio Banhos, os indícios trazidos ao conhecimento da Justiça Eleitoral pelos autores da ação são suficientemente fortes para evidenciar que houve intenção de burlar o cumprimento da norma eleitoral.
“Sendo assim, tendo sido revelado na espécie que as candidatas Tânia de Rildo e Sônia Alves obtiveram votação pífia, não tiveram movimentação financeira, não realizaram atos de campanha e não fizeram a divulgação de suas candidaturas nas redes sociaism , evidencia-se a prática da cota de gênero, razão pela qual dou provimento ao recurso especial, a fim de reformar o acórdão regional para declarar a nulidade dos votos recebidos por todos os candidatos ao cargo de vereador no Município de Canindé de São Francisco pelo Partido dos Trabalhadores no pleito de 2020 e desconstituir os diplomas dos candidatos da legenda para o referido cargo. Desconstituir, também, o DRAP do Partido e determinar o recálculo dos quocientes eleitoral e partidário. E ainda, e por fim, determinar o cumprimento imediato da decisão, independentemente da publicação do acórdão.
