O Ministério Público de Sergipe através da promotora Laura Imperatriz Batalha Moreira Nery Moura instaurou um inquérito para investigar suposta prática de improbidade administrativa e esquema de desvio de dinheiro público em Riachão do Dantas e instruiu em 1º de março deste mês, a ex-prefeita Gerana Costa, o esposo e ex-secretário Laelson Menezes e a nora e ex-secretária Manuela Costa a devolverem ao município de Riachão do Dantas, R$ 52.291,33 (cinquenta e dois mil, duzentos e noventa e um e trinta e três centavos) devido a contestação de recebimento de diárias em total irregularidade.
Segundo apurou o MPE, nos anos de 2017 e 2018 os réus acima citados receberam diárias do município e “os documentos constantes na Prefeitura referem-se, apenas, aos pagamentos realizados, não existindo procedimentos próprios para concessão das diárias em questão, estando assim, em total irregularidade.”
O parecer também indicou que a participação do servidor em seminários e cursos de aperfeiçoamento, ou programas de pós-graduação, ensejam o direito a Licença ou Afastamento, com ou sem remuneração, mas não de diárias, visto que são de interesse do servidor e não da administração pública. Com isso, a decisão reforça que, além de serem condenados a ressarcirem o dano causado ao erário público, os agentes ímprobos devem ser condenados por improbidade administrativa, tendo em vista que ficou comprovado enriquecimento ilícito.
“Em vias de conclusão, após estas exaustivas explanações, ressai transparente que a conduta praticada pelos Réus, fruto de sua intenção consciente de agredir a Lei e de enriquecer-se ilicitamente (causando prejuízo ao erário), ao beneficiar-se com o desvio do “dinheiro do povo diretamente para o seu “bolso”, viola frontalmente a Lei de Improbidade Administrativa”.
