O ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), determinou a saída do ex-ministro Anderson Torres da prisão.
“A presente decisão servirá de alvará de soltura clausulado em favor de ANDERSON GUSTAVO TORRES servirá também de ofício de apresentação ao Juízo da Vara de Execuções Penais do Distrito Federal, no prazo de 24 horas”, escreveu o ministro.
Torres está preso desde 14 de janeiro, em decorrência da investigação por suposta omissão nos atos golpistas do dia 8 de janeiro.
Para permitir a liberdade de Torres, o ministro determinou medidas cautelares que incluem:
uso de tornozeleira eletrônica;
proibição de deixar o Distrito Federal e de sair de casa à noite e nos fins de semana;
afastamento temporário do cargo de delegado de Polícia Federal;
comparecimento semanal na Justiça;
entrega do passaporte à Justiça e cancelamentos de todos os passaportes já emitidos para Torres ;
suspensão de porte de armas de fogo, inclusive funcionais;
proibição de uso de redes sociais; e
proibição de comunicação com os demais investigados no caso.
Na decisão, Moraes informou que não vê mais motivos para Torres continuar preso preventivamente. E que as investigações podem transcorrer com o ex-ministro em liberdade.
“As razões para a manutenção da medida cautelar extrema em relação a Anderson Gustavo Torres cessaram, pois a necessária compatibilização entre a Justiça Penal e o direito de liberdade demonstra que a eficácia da prisão preventiva já alcançou sua finalidade, com a efetiva realização de novas diligências policiais, que encontravam-se pendentes em 20/4/2023.”
Moraes destacou ainda que o descumprimento de qualquer uma das medidas alternativas vai levar Torres de volta à prisão.
