Uma Nova Lei de Trânsito entrou em vigor em abril de 2021. Com isso, muitos motoristas comemoraram, pois houve um significativo aumento no limite de pontos antes de perder a CNH. Sendo assim, esse limite passou de 20 para 40 pontos na carteira de habilitação.
Com a nova Lei de Trânsito, ao atingir 40 pontos ou mais na carteira, a CNH do motorista entra em processo de suspensão. Quando essa nova regra entrou em vigor muitos comemoraram, pois estavam prestes a atingir o antigo limite de 20 pontos.
Por outro lado, muitos motoristas já estavam em processo de suspensão da CNH quando a Nova Lei de Trânsito entrou em vigor. Neste caso, a Câmara dos Deputados recentemente aprovou um projeto que pode ser muito vantajoso para esses motoristas.
A Comissão de Viação e Transportes da Câmara dos Deputados aprovou um projeto no início deste mês. Esse projeto garante aos motoristas que tiveram a CNH suspensa, por ultrapassar o antigo limite de 20 pontos, uma revisão da penalidade, devido ao novo limite de 40 pontos.
Esta medida pode beneficiar os motoristas que ainda estão com a CNH suspensa, os quais acumularam entre 20 e 40 pontos antes da Nova Lei de Trânsito entrar em vigor.
Apesar disso, não é qualquer motorista com a CNH suspensa dessa forma que terá direito a uma revisão da penalidade. Isso porque o projeto prevê a revisão apenas para aqueles que não cometeram nenhuma infração de natureza gravíssima.
Essa proposta tem como relator o deputado Antonio Carlos Rodrigues (PL-SP), e é um substitutivo ao Projeto de Lei 2.654/21. Carlos Rodrigues defende que os motoristas que possuam um processo de suspensão da CNH em andamento, ou seja, a penalidade ainda não foi instaurada, devem contar com a chance de rever esta punição.
No entanto, caso a CNH já esteja suspensa o condutor não poderá contar com esta vantagem proposta pelo projeto, sendo que decisão já foi tomada. É importante destacar que esse projeto ainda não está em vigor, e segue em tramitação até seu caráter conclusivo. Caso vire lei, haverá uma alteração no Código de Trânsito Brasileiro.
Acúmulo de pontos para suspensão da CNH
Mesmo com a Nova Lei de Trânsito, e o aumento do limite de pontos na CNH de 20 para 40, os motoristas devem ficar atentos para que não tenham o documento suspenso por infrações. Isso porque, além do risco de acidentes, o limite de 40 pontos apenas é válido para aqueles que não cometem infrações de natureza gravíssima.
Quanto mais infrações de natureza gravíssima o motorista cometer em um período de 12 meses, menor será o limite de pontos para suspensão da CNH. Confira a seguir o funcionamento deste limite:
- Limite de 40 pontos: para o motorista que não cometer nenhuma gravíssima em 12 meses;
- Limite de 30 pontos: para o motorista que cometer 1 gravíssima em 12 meses;
- Limite de 20 pontos: para o motorista que cometer 2 ou mais gravíssimas em 12 meses.
Sendo assim, os motoristas devem ficar atentos para não acabarem com a CNH suspensa. A critério de exemplo, algumas infrações de natureza gravíssima são: dirigir ameaçando os pedestres ou os outros veículos e a ultrapassagem pela contramão em curvas, aclives e declives, faixas de pedestres, pontes e viadutos, entre outros.
