Após a ação judicial ser ajuizada, o estatuto de limitações não é mais válido. Neste caso, começa a gastar o tempo dos procedimentos. No entanto, se o credor não entrar na Justiça no prazo de cinco anos, ele ainda pode recolher a dívida ou oferecer-se para renegociar, desde que isso não seja feito de forma abusiva.O que acontece se eu não pagar minhas dívidas?
Se, mesmo antes da ordem da justiça ser emitida, o devedor poderá apreender seus bens, até que a dívida seja coberta. Assim, a Justiça pode levar carros e casas para leilão, para que os valores arrecadados sejam utilizados para pagar dívidas.
Se a mercadoria for usada como garantia para pagamento, ela pode ser tomada sem o envolvimento do juiz. Pelo contrário, só pode ser tomada pelo tribunal após o credor ter instaurado uma ação contra ele.
É importante ressaltar que o imóvel em que a família vive não pode ser tomado. Além da apreensão de mercadorias, o consumidor também pode ter bloqueado contas para garantir o pagamento da dívida.
