A Comissão de Previdência, Assistência Social, Infância, Adolescência e Família da Câmara dos Deputados está reunida no plenário 1 para votar proposta que inclui no Código Civil a proibição da união homoafetiva. A comissão precisou mudar para uma sala maior a fim de possibilitar a participação de representantes da sociedade civil que acompanham a votação.
De autoria do ex-deputado Capitão Assumção (ES), o Projeto de Lei (PL) 5167/09 proíbe que relações entre pessoas do mesmo sexo equiparem-se ao casamento ou a entidade familiar.
Ontem a proposta recebeu críticas em audiência na Câmara.
O PL 5167/09 tramita apensado ao Projeto de Lei 580/07, do ex-deputado Clodovil Hernandes (SP), que vai no sentido contrário e permite que duas pessoas do mesmo sexo possam constituir união homoafetiva por meio de contrato em que disponham sobre suas relações patrimoniais.
O parecer do relator na Comissão de Previdência, deputado Pastor Eurico (PL-PE), é pela rejeição do projeto do ex-deputado Clodovil e pela aprovação do PL 5167/09.
Decisão do STF
Desde 2011, o Supremo Tribunal Federal (STF) reconhece a união homoafetiva como núcleo familiar, equiparando as relações entre pessoas do mesmo sexo às uniões estáveis entre homens e mulheres.
