Os membros do Tribunal Regional Eleitoral de Sergipe determinaram, por maioria dos votos, a perda do mandato de vereador de Aracaju Zezinho do Bugio (PSB) por infidelidade partidária.
De acordo com o TRE-SE, o diretório municipal do Partido Social Democrático (PSD) requereu a perda do mandato de Zezinho do Bugio alegando infidelidade partidária. Segundo o PSD, o parlamentar não se enquadraria nas hipóteses previstas na legislação que autorizam a troca de partido para detentores de mandato.
A defesa do vereador e do Partido Socialista Brasileiro (PSB), nova agremiação de Zezinho, alegaram que “o parlamentar sofreu grave discriminação pessoal, consubstanciada em sua preterição e desprestígio promovido pela agremiação requerente (PSD), culminando com a negativa de legenda para o político concorrer nas Eleições Gerais de 2022”.
De acordo com o relator do caso, juiz membro Breno Bergson, a atribuição de escolher ou negar a inclusão de candidatos ao cargo de deputado estadual ou federal compete exclusivamente ao diretório estadual, por meio de convenção partidária. “Não se admite o suposto mandato verbal, pois a jurisprudência do TSE é clara ao dizer que a anuência partidária com a desfiliação deve se dar por meio de documento escrito, o que não se avista nos autos. Assim, afasto a anuência do partido de origem como justificativa para desfiliação”, disse o juiz determinando o imediato e definitivo afastamento de do vereador da Câmara Municipal de Aracaju.
Além disso ficou decretada a posse do respectivo suplente do PSD, conforme a ordem de suplência definida nas eleições de 2020 no prazo de 10 dias.
Zezinho do Bugio já havia sido afastado da Câmara de Vereadores de Aracaju em maio do ano passado e retornado no mês seguinte.
