Os senadores Laércio Oliveira (PP) e Alessandro Vieira (MDB) deram voto favorável; já o senador Rogério Carvalho (PT) foi contrário.
O projeto tem relatoria do senador Flávio Bolsonaro (PL) e proíbe as saídas temporárias para visitas a familiares ou de retorno ao convívio social, as chamadas ‘saidinhas’, que hoje acontecem em feriados e datas comemorativas. No entanto, a proposta prevê que os detentos que atenderem a condicionantes (veja abaixo) poderão deixar as unidades prisionais para estudar ou trabalhar.

Pela atual legislação, o benefício é concedido a detentos que cumprem pena em regime semiaberto, tenham bom comportamento e já tenham completaram parte da punição (de um sexto a um quarto da pena de acordo com antecedentes criminais).

Uma emenda apresentada pelo senador Sérgio Moro (União Brasil) foi acatada e, assim, o novo texto extingue a possibilidade de saída para visitas e atividades para a reinserção social, mantendo apenas a autorização para estudo e trabalho de detentos do regime semiaberto.
O benefício não será concedido a condenados por crimes hediondos ou por crimes com violência e grave ameaça contra pessoa.
